When the Cubs selected him in Rule 5 after the 2006 season, he had had about 60 PA since 2002. I don’t see how anybody could’ve expected him to do this based on his time away from the game alone. When you factor in the baggage, he’s definitely a stay away guy.

The equal protection element was resolved that different counties used different standards when recounting the ballots, so that a voter on one county might have their ballot counted one way while the same ballot in a different county might have it go the other.
I don’t understand your question about the 10th amendment. Given that the 14th amendment states that, “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws,” there’s no need for any further legal gymnastics.
The way I am reading this case: Each state holds its separate election for the electoral college votes. When the recount was going to be conducting differently in each county George W argued that it was a violation of the Equal Protection Clause thus allowing the Federal Gov to preempt the state and decide the ellection. Correct me if I am wrong. Don’t want Horowitz to eat me alive!

I contacted the A’s about it, and they emailed me back today. The music was made for that commercial by a company in LA that specifically makes commercial music. The guy gave me the name of the ad agency in charge of the A’s marketing because he couldn’t think of the name of the LA company.
I’m thinking, the music we wear, that’s all of the song. But I still need to contact at least two more people to see if this music is somewhere I can download it. If not, I’m thinking about going the Firefox route to save the commercial.
